Flood Packs Inc. (“Flood Packs”, "we", "us", or "our") and is committed to ensuring transparency, privacy, and compliance with applicable data protection regulations, including the Personal Information Protection and Electronic Documents Act (PIPEDA) for Canada and the California Consumer Privacy Act (CCPA) & California Privacy Rights Act (CPRA) for U.S. customers.

Section 1: Terms of Service

1.1 Acceptance of Terms

By accessing or using our website, products, or services (collectively, the "Services"), you agree to these Terms of Service (“Terms”), including any additional policies referenced herein or otherwise communicated by email or linked on our website, which govern your access to and use of all aspects of our Services, including any material, content, functionality, or information in respect of our Services (“Content”). If you do not agree with these Terms, please refrain from using our Services. If you have any questions, contact us at support@floodpacks.com.  

These Terms may be updated periodically, with continued use of the Services constituting acceptance of those updates.

1.2 Eligibility

Our Services are available only to individuals who can legally enter into binding contracts under the laws of their respective jurisdictions.
Key Requirements:

  • You must be at least 18 years old or the legal age of majority in your location.

  • If you are under 18, you may use the Services only with the involvement of a parent or legal guardian.
    Flood Packs reserves the right to refuse service, close accounts, or cancel orders at its discretion.

1.3 Account Registration

To access some of our features, you may need to create an account. By registering:

  • You confirm that all information provided is accurate, complete, and current.

  • You accept responsibility for maintaining the confidentiality of your account and password.

  • You agree to notify Flood Packs immediately of any unauthorized access to your account.

1.4 User Conduct

You agree not to misuse the Services. Specifically, you will not:

- Engage in illegal or fraudulent activities.
- Attempt to gain unauthorized access to the Services or accounts.
- Use automated systems (e.g., bots) to interfere with the Services.
- Upload or share harmful or objectionable content.

Flood Packs reserves the right to investigate and take legal action against users who violate these Terms.

1.5 Orders and Payment

All orders placed on our website are subject to acceptance and availability. By placing an order:

- You confirm that you are authorized to use the payment method provided.
- You accept that prices, promotions, and availability are subject to change without notice.

Payment Methods: We accept major credit cards, PayPal, and other specified payment gateways.
Taxes and Fees: You are responsible for applicable sales tax, VAT, or customs duties for international orders.

1.6 Governing Law and Disputes

These Terms are governed by the laws of British Columbia, Canada and the federal laws of Canada applicable in the Province of British Columbia. If a dispute arises, parties agree to first attempt resolution through direct communication. 


The parties irrevocably agree to submit to the exclusive jurisdiction of the courts of the Province of British Columbia with respect to any dispute or claim arising out of or in connection with these Terms .You hereby waive all objections to the exercise of jurisdiction over you by such courts and to the venue of such courts. 


The United Nations Convention on Contracts for the International Sale of Goods will not apply to these Terms and is hereby expressly excluded. 

1.7 Limitation of Liability

To the fullest extent permitted by law:

- Flood Packs’ total liability is limited to the lesser of $100 or the total amount paid for the Services related to the claim.
- In any event, Flood Packs is not liable beyond any applicable insurance coverage.
- We disclaim liability for special, incidental, punitive, indirect, or consequential damages arising from the use of our Services.
- Flood Packs is not responsible for delays or interruptions caused by external factors, including but not limited to shipping carrier delays or supply chain disruptions.
- Nothing in these Terms excludes liability for fraud, personal injury, or statutory rights under applicable consumer protection laws.

1.8 Changes to Terms

Flood Packs reserves the right to update these Terms from time to time. Changes will be posted on our website and significant updates may be communicated via email. You may also be asked to agree to our Terms prior to completing each purchase. 

1.9 Entire Agreement

Subject to modifications as contemplated herein, these Terms constitute the sole and entire agreement between you and Flood Packs regarding the subject matter herein and supersedes all prior and contemporaneous understandings, agreements, representations and warranties, both written and oral, regarding such subject matter.

1.10 No Waiver

No failure to exercise, or delay in exercising, any right, remedy, power, or privilege arising from these Terms operates, or may be interpreted, as a waiver thereof. No single or partial exercise of any right, remedy, power, or privilege hereunder precludes any other or further exercise thereof or the exercise of any other right, remedy, power, or privilege.

1.11 No Third Party Rights

These Terms do not confer any legal, equitable, or other rights or remedies of any nature whatsoever upon any third party who has not been authorized to use or granted access to the Services. This does not affect the rights of any permitted assignee or transferee of these Terms.

1.12 Successors and Permitted Assigns 

These Terms are binding upon and inure to the benefit of the parties to the Terms and to their respective heirs, successors, permitted assigns and legal representatives.

1.13 Severability

If any term or provision of these Terms is invalid, illegal, or unenforceable in any jurisdiction, such invalidity, illegality, or unenforceability will not affect any other term or provision of these Terms or invalidate or render unenforceable such term or provision in any other jurisdiction.

1.14 Assignability

You may not assign or transfer any rights or obligations under these Terms and any attempt to do so will be void. We may assign our rights or obligations under these Terms to any affiliate, subsidiary, or successor in interest of any business associated with the Services.


1.14 Third-Party Websites and Applications

For your convenience, and or as part of the functionality of certain Services, the Services may provide links or pointers to third-party websites or applications. We make no representations about any other websites or applications that may be accessed through our Services. If you choose to access any such websites or applications, you do so at your own risk. We have no control over the contents of any such websites and applications and accept no responsibility for such websites and applications or for any loss or damage that may arise from your use of them. You are subject to any terms and conditions of such third-party sites and applications.

Section 2: Intellectual Property and Content

2.1 Ownership 

You understand and agree that the Content is and will exclusively be owned by Flood Packs, its licensors, or other providers of such material and are protected in all forms by intellectual property laws, including copyright, trademark, patent, trade secret, and any other proprietary rights. 

2.2 Trademarks.

Flood Pack’s name, logos, and all related or affiliated names, logos, product and service names, designs, images, and slogans are trademarks (collectively, “Trademarks”) of Flood Packs or its affiliates or licensors. You will not use any Trademarks without the prior written permission of Flood Packs. Other Trademarks mentioned or which appear or are provided through our Services may be the Trademarks of their respective owners. Use of any such third party Trademarks, except as expressly authorized herein, will constitute an infringement or violation of the rights of the property owner and may be a violation of federal or other laws and could subject the infringer to legal action. 

2.3 Flood Packs License Grants

Subject to these Terms, Flood Packs grants you a limited, non-exclusive, non-assignable, nonS-sublicensable, non-transferrable, revocable, royalty-free, worldwide license to access certain Services and Content as they may be made available to you from time to time. 

2.4 Your License Grants

By providing accessing our Services, and subject to these Terms, you hereby agree to grant us and our licensees, successors and assigns a non-exclusive, world-wide, royalty-free and fully paid, perpetual, irrevocable, assignable and sublicensable, licence and right to use your User Content (as defined below) for any lawful use or business purpose, including analytics, benchmarking, research, and general training and improvements to our Services, sharing with external third parties, reproducing, copying, and transmitting to third parties, all without requiring further notice or consent and to the extent compliant for privacy laws, including Canadian federal privacy laws such as the Personal Information Protection and Electronic Documents Act (PIPEDA). You further waive any and all moral rights, and upon request will waive all moral rights while using and after ceasing to use our Services, in respect of your User Content.


In this section, “User Content” means any and all information and content that you provide, submit to or engage, use, access, or generate from or using any of our Services (e.g. browsing on our website).  

2.5 Use of and Access to the Content

Except as expressly agreed in with an authorized representative of Flood Packs, you may only access the Content for your personal and non-commercial use. Users are not permitted to extract, create, or modify Content and you will not delete or alter any copyright, trademark, or other proprietary rights notices thereon. 

2.6 Flood Packs’ Reservation of Rights

You have no right, title, or interest in or to the Services or any Content, and Flood Packs reserves all rights not expressly granted in these Terms. Any use of the Services or Content not expressly permitted by these Terms, or otherwise permitted through features and functionality, is a breach of these Terms and may infringe or violate copyright, trademark, and other intellectual property or other proprietary laws.

Section 3: Privacy Policy

Flood Packs respects your privacy and is committed to protecting your personal data. This Privacy Policy explains how we collect, use, and share your information. For further details, see:

- California Consumer Privacy Act (CCPA)
- Canada's Personal Information Protection and Electronic Documents Act (PIPEDA)

3.1 Data Collection & Usage

We collect and process the following types of personal information:  

- Identifiers: Name, email address, billing/shipping address, phone number.  

- Transaction Data: Purchase details and payment information (processed securely via third-party providers).  

- Usage Data: Device type, IP address, cookies, and website interactions for analytics and security.  


How We Use Your Data:

- Order Fulfillment: To process and ship orders.  

- Customer Support: To assist with inquiries or concerns.  

- Marketing (With Consent): To send promotions and product updates. No pre-checked opt-in boxes will be used. 

- SMS Marketing: With your consent, we may send you SMS/text messages related to your orders, account updates, and marketing promotions (such as restock alerts or product drops). Message frequency may vary. Message and data rates may apply. Your phone number will be used solely for these purposes and will not be shared or sold to third parties for their marketing purposes. You can opt out at any time by replying STOP or contacting us at support@floodpacks.com.

We do not sell your personal data to third parties. However, in accordance with these Terms, we may share certain User Content with authorized partners (e.g., Shopify, analytics providers) to enhance your shopping experience.

This does not include SMS opt-in data and consent, which will not be shared with any third parties.


3.2 AI & Machine Learning Usage

- Flood Packs prohibits unauthorized AI training on our website content. You will not directly or indirectly reproduce, compile for an internal database, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of Content, in any form, medium or technology whatsoever, except your computer and browser may temporarily store or cache copies of materials being accessed and viewed.

- Authorized partners (e.g., Shopify, customer support tools) may use AI/ML strictly to improve user experience.

3.3 Customer Rights Under PIPEDA & CCPA

- Right to Access: Customers can request a copy of their stored personal information.  

- Right to Deletion: Customers may request data deletion, except when retention is legally required (e.g., transaction history for tax compliance).  

- Right to Opt-Out (CCPA Only): California residents can request that their personal data is not shared with third parties for targeted advertising.  

- Right to Data Portability: Customers may request their data in a commonly used, machine-readable format.

3.4 Data Retention

We store your data only for as long as necessary to fulfill the purposes outlined. Flood Packs uses industry-standard encryption and security measures to protect your information.

3.5 Privacy Officer & Compliance

Our designated Privacy Officer is responsible for overseeing compliance with privacy laws and addressing inquiries. You may contact the Privacy Officer at privacy@floodpacks.com.

Section 4: Shipping, Returns, and Warranty Policy

Flood Packs is committed to providing customers with clear and comprehensive information about our shipping, returns, and warranty processes. Please review the following policies to ensure a seamless shopping experience.

4.1 Shipping Policy

Flood Packs offers two shipping speeds within the United States, Canada, and select international destinations:

- United States:

  • Standard Ground Shipping: Estimated delivery time is an average of 7 business days.

  • Express Shipping: Estimated delivery time is 2-3 business days.

-Canada & International:

  • Standard Shipping: Estimated delivery time is an average of 10 business days.

  • Express shipping is not available for international destinations.

Important Notes:

- Orders to Alaska (AK) and Hawaii (HI) require additional transit time, averaging 10-14 days.
- Flood Packs does not ship to APO/FPO addresses. Local pickup is not available for any order.

Carrier Delays:

While we strive to meet delivery estimates, delays caused by shipping carriers (e.g., weather events, labor disruptions) may occur. Flood Packs is not responsible for such delays.

Address Accuracy:

Customers are responsible for providing an accurate and complete delivery address at checkout. Flood Packs is not liable for:

- Packages shipped to incorrect addresses provided at checkout.
- Returned packages due to undeliverable addresses.

If a package is returned as undeliverable, the customer will bear the cost of re-shipping. Additionally, such instances are not covered under Route Shipping Protection (see Section 3.2).

4.2 Route Shipping Protection 

- Route Shipping Protection is available at checkout and covers lost, stolen, or damaged packages. This protection is pre-selected by default for all orders but can be deselected at checkout if desired. 

- If customers opt out of Route Protection, they accept full responsibility for any shipping-related issues beyond standard carrier coverage.  Flood Packs will not be liable for reimbursement in such cases.

4.3 Returns & Refunds

- Customers have 30 days to return eligible products in new, unused condition with all original packaging.
- A 20% restocking fee applies for items missing original packaging.

Eligible Returns:

- Items must be new, unused, and in original packaging.

Ineligible Returns:

- Used items or items missing original packaging (e.g., a removed plastic seal on a bite valve).

Return Process:

1. Contact returns@floodpacks.com to request a return authorization number.
2. Include proof of purchase and a detailed reason for the return.
3. Ship the item back to Flood Packs using a trackable method.

Inspection & Refunds:

- Refunds are processed after inspection. Items used or damaged will not qualify.
- Flood Packs reserves the right to delay refunds until inspection is complete.

 

 

4.4 Warranty Policy

- Flood Packs offers a one-year limited warranty covering manufacturing defects.
- Defective items must be returned for inspection before a replacement is issued.

Defective Product Returns:

- Flood Packs will replace defective items at no cost, including shipping.
- Items must be returned for inspection.

Non-Qualifying Defects:

- Damage caused by improper use, misuse, or non-manufacturer defects is not covered.

Warranty Claim Process:

1. Contact warranty@floodpacks.com with your order number and photos of the defect.
2. Include your name, order number, and a brief issue description in the return package.
3. Flood Packs will assess the defect based on historical quality records.

- If the defect is not manufacturer-related, the item will be returned at the customer’s expense.
